Редко переводила юридические тексты, и тут какой-то на практике слишком заковыристый попался. Будьте добры, подскажите парочку терминов.

1. В каком значении здесь value? positive value(s), disvalue.
Контекст:
Deserved punishment is a positive value, but it is not the only positive value. Seeing that people receive their negative desert may be an aim of criminal punishment for the moderate retributivist as it is for the strong retributivist; but for the moderate but not the strong retributivist, other values define the circumstances in which pursuit of that goal is properly undertaken. On the other hand, for the moderate retributivist as for all retributivists, undeserved punishment, if administered with knowledge that it is undeserved, is always a trumping disvalue.

2. comparative and noncomparative injustices - нигде не нашла как звучат эти понятия на русском. Если они вообще есть в русском.
Контекст:
A corollary to our rejection of strong retributivism is the potential for comparative and noncomparative injustices, and this effect introduces a second conundrum for retributivism – the question of how retributive desert is measured. We must first ask whether desert is comparative or noncomparative.

3. deserved punishment так и будет "заслуженное наказание?" или есть какой-то другой термин?

4. weight relative (?)
Контекст:
Weak retributivism represents zero weight relative to the strength of the side constraint forbidding giving anyone more punishment than is deserved

так и будет "заслуженное наказание?" - да

1 positive value - положительное значение (см. МТ)
заслуженное наказание имеет положительное значение/играет положительную роль

2 disvalue - незаслуженное наказание, особенно если применяется осознанно, всегда наносит вред

4. weight relative (?)
надо смотреть др. связку "relative to" - по отношению к ("represents zero weight" "relative to")

А вот value здесь встречается снова, но здесь же нельзя употребить "оценку" или "эффект"?
