Without prejudice to Clauses 3.1 and 3.2 (above) and subject to the remainder of this Clause 3.4 and any express arrangements in relation to information received, CS shall treat all information received from the Customer or regarding the Customer or its Transactions
as confidential for so long as such information remains non public, and will not disclose this information without the Customer’s prior consent. For the avoidance of doubt, information which (i) was already in the possession of CS prior to delivery by the Customer, (ii)
was or becomes generally available to the public other than as a result of disclosure by CS, (iii) becomes available to CS on a non confidential basis from a source other than the Customer, provided that CS does not know that such source is bound by a confidentiality
agreement with, or obligation of secrecy to the Customer, or (iv) was or is independently developed by us, shall be excluded from this
confidentiality obligation.
