Subject: court proceedings in support of arbitration (d) If court proceedings (not being court proceedings in support of arbitration) are initiated by any person (other than X), X shall have thirty (30) days from the date upon which the existence of the court proceedings comes to the attention of the X to choose to have the Dispute resolved by arbitration in accordance with this item 40 and shall notify Yand the other parties of its choice in writing accordingly.
