In the first Arbitration, the Respondent denied liability for repayment of any sums to the Claimant on the basis of an exemption clause set out at Article 8 of the Trust Deed and, as a result, the Tribunal declined to order, in its First Partial Award, that the Respondent make payment to the Claimant of the sums incorrectly drawn down from the Claimant’s security.
