Upon any such termination, CONTRACTOR shall waive any CLAIMS AND LOSSES for all damages, including loss of anticipated profits, on account thereof, but as the sole right and remedy of CONTRACTOR, COMPANY shall pay to CONTRACTOR in accordance with Article 23.4 below, provided, however, that those provisions of AGREEMENT which by their very nature survive the issue of FINAL ACCEPTANCE CERTIFICATE shall remain in full force and effect after such termination to the extent provided in such provisions.
