Where either Party identifies a need for Early Works to be performed prior to the commencement of the Construction Phase, the Employer may request that the Contractor submit within 10 working days (or such longer time that the parties agree) a proposal to the Employer for the performance of such Early Works in accordance with this Agreement:
- setting out a lump sum price for the Early Works including the Overhead and Profit Percentage ("Early Works Price");
- propose for the parties' prior agreement, other terms and conditions in respect of the Early Works.
