agreed fee - Agreement fee ?

In case of failure to meet the performance time the sub consultant pays to RMJM a penalty fee in the amount of 0.5% of cost of servicess for each day in arrears, but not more than 50% of the agreed fee.
In case of failure to meet the due dates of payment stipulated in the section 3 of the Agreement, RMJM pays the Sub consultant penalty fee in the amount of 0.5 % of the sum to be transferred, for each day in arrears, but no more than 50% of the Agreement fee.
