Добрый вечер, уважаемые форумчане. Помогите, пожалуйста, перевести термин "special equity" в нижеследующем контексте!

While the parties look forward to and hope and expect to enjoy a long, happy and lasting marriage, terminated only by the death of one of them, they also recognize the present-day reality of; the possibility that their marriage might be terminated by way of dissolution, divorce or annulment during the lifetime of both parties. They believe that resolution of as many financial aspects as possible in advance may well promote the happiness and harmony of their marriage. In the event of such termination of marriage during the lifetime of both parties by way of divorce, dissolution or annulment, regardless of which party shall initiate such action and regardless of the jurisdiction, venue or location of such action, the parties hereby specifically waive, now and forever, any and all rights either party may have to support from or property of the other, whether it be alimony pendente lite, temporary alimony, rehabilitative or permanent alimony, permanent periodic alimony, lump sum alimony for spousal support, lump sum alimony for purposes of an equitable distribution of property, bridge-the gap alimony, special equity in the other's property, or any other form of alimony for purposes of support, or other property distribution, including claims for community property and claims for attorney's fees.

право собственности на совместно нажитое имущество, не подлежащее разделу при расторжении брака

По вашей собственной ссылке как раз не "совместно нажитое". Там же написано, если один из супругов вложил в недвижимость больше, чем должен был. Например, женился, когда половина дома уже была выплачена или родители оставили наследство, которое он использовал для выплаты ипотеки. Это не "совместно нажитое".

Вот нашел нечто похожее:

Собственность, как известно, может быть общей. Общая собственность в свою очередь может быть общей совместной и общей долевой собственностью.

Совместная собственность супругов может стать долевой собственностью если нотариально удостоверенным соглашением сторон определены доли каждого собственника, или в судебном порядке определены и выделены доли каждого собственника в общей собственности.
