Пожалуйста, помогите перевести: в случае неисполнения или несвоевременного исполнения гарантийных обязательств.

Выражение встречается в следующем контексте: В случае неисполнения и (или) несвоевременного исполнения Подрядчиком своих гарантийных обязательств, Заказчик имеет право взимать пени в размере 0,02 % от суммы Договора за каждый день просрочки, но не более 10% от суммы Договора.
