1.4. Circumstances may arise where, because of a default on Client’s part or other liability, Entity-D is entitled to recover damages from Client. In each such instance, regardless of the basis on which Entity-D is entitled to claim damages from Client (including fundamental breach, negligence, misrepresentation, or other contract or tort claim), Client is liable for no more than:

the amount of any other actual direct damages up to the greater of:

the equivalent of U.S. ___________ in local currency converted according to the exchange rate published by the Central Bank of Russia on the business day preceding the date of payment of the relevant invoice by Entity-D or, if none, the date of Client’s breach;
